• manage bookings, payments, and session delivery
• tailor sessions safely (including modifications)
• communicate with you (changes, confirmations, support)
• meet legal and recordkeeping obligations
• improve our services and website
• marketing (only where you’ve consented or it’s otherwise permitted)
3. How we store and share information
We store information securely using reputable service providers (e.g., booking platforms, payment processors, email providers). We may share information with:
• service providers who help us operate (booking/payment/IT)
• professional advisers (e.g., accountant, solicitor) where necessary
• regulators/law enforcement where required by law
• emergency responders if needed for safety
We do not sell your personal information.

1. Agreement
By booking, purchasing, attending, or participating in any session at Form Haus Studio, you confirm that you:
• have read and understood these Terms & Conditions;
• agree to be legally bound by them; and
• agree to all linked policies, including:
(a) Cancellation & No-Show Policy
(b) Studio Rules & Safety (Home Studio)
(c) Risk Warning, Waiver, Release & Health Declaration
(d) Privacy Policy These Terms apply each time you attend.
2. Nature of services
Form Haus Studio provides private (1:1) and duet (2-person) Pilates sessions, including reformer and/or mat-based exercise. Pilates is a physical and recreational activity involving strength, resistance, balance, coordination, and movement, and participation carries inherent risks. No specific outcomes, results, or improvements are guaranteed.
3. Home-based studio disclosure
Form Haus Studio operates from a private residential home, not a commercial fitness facility. By attending, you acknowledge and agree that:
• you are entering private property as an invited guest;
• access is strictly limited to designated client areas and pathways;
• all other areas of the home are off-limits at all times;​
• you must comply immediately with any instructions given for safety, privacy, or household reasons;
• we may refuse or revoke access where we reasonably believe safety, privacy, or compliance is compromised.
4. Bookings
• All bookings must be made via Wix Bookings unless otherwise agreed in writing.
• Bookings are not confirmed until payment and required acknowledgements are completed.
• You must complete and accept the Risk Warning, Waiver & Health Declaration before your first session and re-accept every 6–12 months, or earlier if your health status changes.
5. Attendance & punctuality
• Please arrive 5–10 minutes early.
• Late arrival may result in a shortened session or refusal of entry where entry would disrupt the session or create a safety risk.
• If entry is refused due to lateness, the session will be treated as a late cancellation or no-show in accordance with the Cancellation Policy.
• You agree to follow all instructor directions and studio safety rules at all times.
6. Duet sessions
• Duet sessions involve shared participation with another client.
• You acknowledge that exercising in a shared session carries additional risks, including movements being modified to accommodate another participant.
• You are responsible for ensuring the other participant you attend with is suitable and compliant.
• To the extent permitted by law, we are not responsible for injury arising from the actions or limitations of another participant.
7. Payments, packages & expiry
• All sessions, packs, and memberships are non-refundable and non-transferable, and subject to stated expiry dates.
• Unused or expired sessions are forfeited unless required otherwise by Australian Consumer Law.
• Prices, schedules, and services may change at any time.
• Limited suspensions or holds may be granted at our discretion (for example, due to injury) and may require supporting documentation.
• Payment is required at the time of booking or purchase unless otherwise agreed.
• You authorise us and our payment processor to charge fees due under these Terms, including late cancellation and no-show fees.
• Failed payments may result in booking suspension until resolved.
8. Cancellations by us
We may cancel or reschedule sessions due to illness, equipment issues, weather, emergencies, household circumstances, or events beyond our reasonable control. Where we cancel a session, you will be offered a credit, reschedule, or refund (at our discretion), unless required otherwise by law.
9. Health, pregnancy & postpartum participation
You acknowledge and agree that:
• you are physically and medically able to participate;
• you will disclose all relevant medical conditions, injuries, surgeries, pregnancy or postpartum status, and limitations before participating and as they change;
• you will stop immediately and notify the instructor if you feel unwell, dizzy, short of breath beyond normal exertion, experience pain, bleeding, or unusual symptoms;
• you will not participate while ill, contagious, intoxicated, or impaired.
Pilates during pregnancy and postpartum carries additional risks, including joint instability, pelvic floor dysfunction, diastasis recti, balance changes, cardiovascular strain, and complications related to pregnancy or recovery. You acknowledge that:
• exercise modifications reduce but do not eliminate risk;
• you are solely responsible for ensuring you are medically fit to participate;
• we may require medical clearance, modify sessions, or refuse participation where reasonably necessary for safety.
10. Client responsibilities
You agree that you will:
• provide accurate and complete health information;
• follow all instructor directions;
• use equipment only as instructed;
• not use equipment unsupervised;
• act respectfully toward instructors, other clients, and the home environment.
11. Minors
Clients under 18 years of age are not permitted to attend sessions.
12. Refusal or termination of service
We reserve the right to refuse or discontinue services where we reasonably believe that:
• safety is compromised;
• instructions are ignored;
• behaviour is inappropriate or disruptive;
• health disclosures are withheld or inaccurate;
• payment obligations are not met.
13. Personal property
You bring personal belongings onto the premises at your own risk. To the maximum extent permitted by law, we are not responsible for loss, theft, or damage to personal property.

14. Intellectual property
All programs, class formats, written materials, and website content remain the intellectual property of Form Haus Studio. Recording of sessions is not permitted without prior written consent.
15. Privacy
We handle personal information in accordance with our Privacy Policy.
16. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights under the Australian Consumer Law that cannot legally be excluded. Where legally permitted (including for recreational services), liability for death or personal injury may be limited or excluded as set out in the Risk Warning, Waiver & Release.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of NSW courts.
Liability waiver

1. Risk warning
Pilates is a recreational and physical activity involving movement, resistance, balance, and specialised equipment. Participation involves inherent risks, including but not limited to:
• muscle strains, sprains, or tears
• aggravation of pre-existing injuries
• joint injury or instability
• falls, slips, or impacts
• dizziness, fainting, or cardiovascular events
• pregnancy or postpartum-related complications
• equipment failure or misuse (even when instructions are followed)
2. Pregnancy & postpartum acknowledgment
If you are pregnant or postpartum, you acknowledge that:
• physiological changes increase injury risk;
• modifications reduce but do not eliminate risk;
• you accept responsibility for your decision to participate;
• you will immediately disclose symptoms such as pain, bleeding, dizziness, or discomfort.
3. Your obligations
You agree that you will:
• provide accurate health information;
• follow instructor directions;
• use equipment only as instructed;
• stop immediately if unwell or in pain;
• not attend while ill, contagious, or under the influence of drugs or alcohol.
4. Health declaration
By booking or attending, you declare that:
• you are fit to participate or have obtained medical clearance where appropriate;
• you have disclosed all relevant health information;
• you understand instructors are not medical practitioners and do not provide medical advice, diagnosis, or treatment.
5. Assumption of risk & release
To the extent permitted by law, you voluntarily assume the risks of participation and release Form Haus Studio and its instructors from claims arising from participation, except where liability cannot legally be excluded.
6. Recreational services notice
Pilates may constitute a recreational service. Where permitted by law, liability for death or personal injury may be excluded or limited in accordance with applicable legislation and the Australian Consumer Law.
7. Emergency consent
If you become injured or unwell, you consent to Form Haus Studio seeking medical assistance on your behalf where reasonably necessary.
8. Acknowledgement
You confirm that you have read, understood, and accepted this Risk Warning, Waiver, Release & Health Declaration and had the opportunity to ask questions.
Cancellation & no-show policy

We understand that life can be busy and unpredictable, and we always appreciate open communication. However, as a small, appointment-based business operating from a private studio, late cancellations and no-shows have a direct impact on our ability to operate sustainably. For this reason, our cancellation policy is firm and consistently applied.
Private & Duet Sessions
• 24 hours or more notice: no charge
• Less than 24 hours notice: 100% of the session fee is forfeited
• No-show: 100% of the session fee is forfeited
Late arrival may result in refusal of entry where safety or session flow would be compromised and will be treated as a no-show. Thank you for respecting our time and supporting our small business.
Studio rules & safety policy

These rules are conditions of entry.
• Access is limited to designated studio areas only
• No children, minors, guests, or pets permitted
• Wear appropriate athletic clothing; grip socks recommended or required
• No filming or recording without written consent
•Equipment to be used only under instructor supervision
• Do not adjust springs or straps without instruction
• Do not attend if you have a contagious illness
• Immediately report injury, pain, dizziness, or equipment issues
Failure to comply may result in refusal of service.
